Terms
Breaky for Mac comes with the licence agreement below. Breaky for iPhone comes from the App Store, with its own short terms after it.
Breaky for Mac: the licence agreement
This is the agreement between you and the maker of Breaky (“I”, “me”), an individual resident in Turkey, about using Breaky for macOS. By installing or using the app, you accept it. If you don’t accept it, don’t install it, and if you already have, delete it.
This agreement covers the Mac app. The Breaky iPhone app is delivered by Apple through the App Store, under Apple’s own terms.
What you pay and what you get
Breaky for macOS is a one-time purchase of $59. There is no subscription.
You buy it from Polar, who sell it on my behalf as merchant of record. Your payment, your invoice and your tax are theirs to handle, and the details you give them are covered by their own terms and privacy policy, not by this agreement.
For that payment I give you a personal, non-exclusive licence to install and use Breaky on up to 3 Macs you own or control, under one licence key, for as long as this agreement stands. That’s a licence to use the app, not ownership of it. I keep every right I haven’t given you here.
Every 1.x update is included. If there is ever a 2.0, it is a new purchase, and your 1.x copy keeps working exactly as it did.
The free trial
Before you buy anything you get 7 days, free, with no card and no account. Everything works during the trial.
When the 7 days are up, Breaky stops until a licence key is accepted: it records nothing and calls no breaks. Your record stays on your Mac, and you can still save a copy of it. The trial belongs to the Mac it started on. Nothing about it is checked with me, because there is nowhere to check.
Your licence key
The key is the whole of your licence. Three things can happen to it:
- Activation. When you type the key in, the app asks Polar to put this Mac on it, and then tells you how many Macs the key opens.
- Deactivation. “Remove this Mac” takes this Mac off the key, and Breaky stops on that Mac. The record on the Mac stays exactly where it is. The slot goes back, so you can use it on another Mac.
- The limit. If the key is already on 3 Macs, a fourth is not activated. The app says so and points you at the Mac to free up. Nothing is deleted, and a Mac still in its trial keeps running until the trial ends.
Reinstalling macOS, or wiping the app’s own folder, makes a Mac look new to the key and uses a slot. That is what “Remove this Mac” is for.
The key is yours to keep and yours not to publish. Selling it, sharing it or posting it is a breach of this agreement, and a key that has been published can be disabled.
What the app sends out
Breaky keeps your record on your Mac. There is no Breaky server, no account and no sign-in. Exactly two things ever leave the machine:
- The licence check. Your licence key and a label for this Mac (its name plus 8 characters of a number Breaky made up itself), to Polar, who sold you the key. On its own, at most once a day, and also when you add a key, press Check now or remove this Mac.
- The update check. Which version you are on and that you are on a Mac, to the place the app downloads its updates from. Every 4 hours.
That is the whole list. No record, no window titles, no app names, no minutes, no telemetry, no crash reporting, no analytics company in the middle. If your iPhone is paired with this Mac, the two of them talk to each other over Bluetooth and through nobody’s server.
What Breaky records, and where it sits on your disk, is described in the privacy notice inside the app (Settings, “What Breaky knows”) and in the privacy policy on this site. That notice, not this agreement, is the document about your data.
Refunds
Refunds are Polar’s, under the refund window stated on the purchase page at the time you bought. Ask them, and they’ll ask me if they need to. I’m not adding a second window on top of theirs, and I’m not taking theirs away.
What you can’t do
- Sell, rent, sublicence or redistribute the app, or any part of it.
- Copy it beyond the copies you need to use it yourself.
- Reverse-engineer, decompile or disassemble it, except where the law says you may do so regardless of what this agreement says.
- Work around the licence key, the trial, or the limit on how many Macs one key covers.
- Strip out or hide the copyright and licence notices that ship inside it.
- Pass it off as your own work, or build a competing product out of it.
Personal use
This licence is for you, personally. It does not cover deploying Breaky on other people’s machines. If you are an employer and you want it on your employees’ Macs, this agreement doesn’t give you that right. Ask me and we’ll sort out something that does.
Age
Breaky isn’t built for children. If you’re under 13, it isn’t for you.
Open-source parts
Breaky is built on open-source software written by other people. Those parts stay under their own licences, which are reproduced in THIRD-PARTY-NOTICES.txt inside the app. Where one of those licences gives you more than this agreement does, that licence wins for that part. Nothing in this agreement is meant to take away a right an open-source licence gives you.
No warranty
Breaky is provided as is, with all its faults. I don’t promise it will work without interruption, that it will be free of bugs, that it will be accurate about your hours, or that it will suit any purpose you have in mind. To the extent the law allows, I disclaim every warranty, express or implied, including merchantability, fitness for a particular purpose and non-infringement.
Breaky is a tool for noticing your own working rhythm. It is not medical, psychological or occupational-health advice, and it isn’t a substitute for any of those.
Your record lives on your Mac, and the only copy of it is the one you keep. Save a copy from inside the app now and then, and let Time Machine do its job. I can’t restore what a dead disk takes, because I never had it.
What I’m liable for
To the extent the law allows, my total liability to you, for everything, under any theory, however it arises, is capped at what you actually paid for Breaky. If you paid nothing, that cap is nothing.
I’m not liable for lost profits, lost data, lost time, business interruption or any other indirect or consequential loss.
Some places don’t allow limits like these. Where that’s so, the limits apply as far as that law permits, and no further. Nothing here limits liability that can’t legally be limited, including for death or personal injury caused by negligence, or for fraud.
Ending it
You can end this agreement any time by deleting the app. It ends automatically if you break the terms above. When it ends, stop using Breaky and delete your copies.
Ending it doesn’t touch your record: it’s on your disk, it’s yours, and deleting the app’s folder is how you delete it. The no-warranty and liability sections survive.
Changes
I may update these terms for future versions. The version that came with the copy you installed is the one that applies to it. If I change the terms in a way that matters, the app will tell you.
Governing law
This agreement is governed by the law of the Republic of Türkiye, and the courts of Istanbul have jurisdiction. If you’re a consumer, this doesn’t take away the rights your own country’s consumer law gives you where that law says they can’t be taken away.

Breaky for iPhone: the terms
Breaky for iPhone is delivered by Apple through the App Store, under Apple’s own terms. These are the terms inside the app.
What Breaky is
A tool for your own breaks: it counts the phone, shows the Mac beside it and covers the apps you chose. It never decides for you.
Your copy
Breaky on your iPhone is free for 7 days from the day you first download it. After that it opens through a paired Breaky for Mac, or through a monthly subscription in the App Store. Apple handles the subscription.
Limits are a nudge
A limit covers an app on your iPhone, and iPhone has the last word: Phone, Messages, Maps, Settings and a few other apps are never covered, and your “Always Allowed” list stays open.
As it is
Breaky is offered as it is. iPhone decides when Breaky may run, so a cover or a break message can come late or not at all. Do not rely on it for anything where safety is at stake.
Changes
When these terms change, the app says so before the change applies.
